Terms of Use

Thank you for your interest in our products and services. These General Terms and Conditions constitute the agreement (“Agreement”) between Super Distros LLC dba Manifest FTS (“Manifest”) and you as a user of our services (“Customer”), whether you sign up as a company or as an individual, and whether you have a past or existing contract with Manifest.

Customer Data

Manifest does not own any Customer Data and the Customer has sole responsibility for the accuracy, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all Customer Data. The Customer grants to Manifest a worldwide, royalty-free, and non-exclusive license to access and use the Customer Data, as well as any other material and software you may provided to Manifest, for the sole purpose of providing the services to you as a Customer. This license is valid only as long as this Agreement is in force. Upon termination of the Agreement the license is revoked. For avoidance of doubt, there is no transfer of ownership of Customer Data or any other data or Intellectual Property Rights from Customer to Manifest under this Agreement.

License

Unless otherwise stated, all software solutions are licensed by their respective owners and not Manifest.

All other intellectual property rights are reserved. Permission is granted for temporary use of information or software on Manifest website for press, personal and/or noncommercial viewing only by grant of a license, not a transfer of ownership.

Under this license you may not: Republish material from, sell, rent or sub-license material, reproduce, duplicate or copy material from Manifest. You may read more about our Privacy Policy here: https://manifest.com/privacy-policy, which is an addendum of this Terms and Conditions by reference.

Limitation of Liability

Under no circumstances shall Manifest be liable for any of Customer’s direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use of delivered services or the materials on this site, even if Manifest, our software partners or an authorized representative has been advised of the possibility of such damages.

The use of Manifest services and software recommendations is at Customer’s own risk, and Customer is fully responsible for any claim, expense, liability, or losses arising from any infringement of the Agreement.

Delivery & Ownership

The cusCustomer’s purchased product(s) or service(s) data and/or source files will be provided to Customer once payment is received and work is completed. Even though services are generally rendered within the estimated delivery time, it may take more or less time to be completed. Manifest will in know way be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising from a delay of deliverability of services from Manifest to Customer.

Updates

The software upon which Manifest digital services rely are constantly updated to be compatible with the latest stable versions. Please ensure that we always use the most current version of said software at the time of Customer’s project start, afterwhich The Customer is responsible for maintenance and security updates unless Manifest is contracted for maintenance and support.

Help & Support

Help and support will be billed as needed unless included as part of an existing contract. All contracts will include the scope of said help and support (if any) from Manifest to The Customer.

Price Changes

Manifest reserves the right to modify our pricing, hourly rates or suspend (temporarily or permanently) any subscriptions at any point of time and from time to time with or without any notice.

Refund Policy

No Refunds on Digital: Manifest reserves the right to change our refund policy at any time. Refunds are not applicable for digital products or services under any circumstance.

Partial Refund on Retainers: Manifest reserves the right to change our refund policy at any time. Partial refunds of up to and not exceeding 50% can be provided at our discretion for any unused retainer hours already paid by The Customer.

Email & Newsletter

Manifest may occasionally send The Customer emails related to the purchase of product(s) and services(s) from Manifest. Manifest may also send The Customer occasional email newsletters relating to related software updates and promotions. Manifest will never sell or release The Customer’s email to any third party vendors. The Customer may opt out of these emails at any time without penalty.

License Agreement

By purchasing our product(s) and service(s), you indicate and consent that you have read and agree to the Terms & Conditions listed and detailed on this page. Manifest reserves the right to change or modify the current Terms and Conditions without prior notice or consent.

Severability

If any part of this Agreement is declared unenforceable or invalid, all remaining clauses in this Agreement shall remain binding on The Customer.

Promotions

WordPress Hosting & Management Terms

Summary: Manifest FTS offers scalable, managed WordPress hosting plans designed to support your business goals. Plans include performance-optimized infrastructure, backups, SSL, and quarterly maintenance. You retain ownership of your content, while infrastructure and platform-level configurations remain licensed and managed by Manifest.

Clients enrolled in any WordPress Hosting Plan agree to the following terms:

  • Hosting Plans: Each plan includes specific features and limitations. Starter includes 1 WordPress install, 25,000 monthly visits, 10GB storage, and 50GB bandwidth. Growth and Enterprise plans increase limits and add features such as performance insights, quarterly security reviews, and DevOps support. Full plan details are listed on our hosting page.
  • Plan Scope: All plans include quarterly WordPress maintenance. Additional support, development work, or performance tuning may be billed separately unless covered under a promotional offer or retainer agreement.
  • Access & Control: Clients have access to the WordPress admin dashboard, but do not receive root, cPanel, or database credentials. Platform infrastructure is fully managed and optimized by Manifest to ensure security and stability.
  • Backups & Uptime: We provide daily backups and make reasonable efforts to ensure uptime and security. However, we do not guarantee 100% uptime and are not liable for third-party outages, plugin failures, or customer-introduced errors.
  • Migration: If migrating from another host, Manifest will assist with one-time migration of WordPress files and database. The client is responsible for DNS access and third-party service coordination (e.g., email, CDN).
  • Performance Optimization: Our team monitors site performance and may recommend or apply server-side caching, image optimization, and code cleanup as part of Growth or Enterprise plans.
  • Custom Work: Custom features, API integrations, or non-standard plugins may be reviewed for compatibility, but are not guaranteed. Enterprise clients may receive priority support and tailored solutions.
  • Promotional Entry: Active Growth or Enterprise plan subscribers who sign up or migrate after November 11, 2024 are automatically entered to win 10 free development hours ($1200 value). Winners are announced quarterly on the “Ahead with FTS” blog. Previous winners within the same calendar year are not eligible for repeat entry.
  • Billing: Subscription fees are billed monthly. Failed payments may result in suspension after 15 days. Canceling the plan stops future billing but does not issue a refund for the current period.
  • Termination: Manifest FTS reserves the right to suspend or terminate hosting services for violations of these terms, non-payment, misuse of server resources, or abusive behavior.
Free Website Promotion Terms

Summary: The Free Website Promotion waives the upfront setup fee in exchange for an active monthly support subscription. You retain ownership of your submitted content (text, images, logo), but the website design, source code, and backend remain licensed by Manifest FTS. Full admin access is restricted. Late payments may result in site suspension.

Clients enrolled in this promotion agree to the following terms:

  • Websites are built using pre-designed templates provided by ManifestFTS, and include up to five standard pages. Clients must choose from the available templates; design changes are not permitted except for minor visual adjustments (such as logo, colors, or small layout tweaks).
  • Access to the codebase, FTP or hosting control panel is not provided. However, limited WordPress admin access may be granted solely for posting and managing blog content.
  • Website delivery is included with your subscription. Upon signup, your website will be setup and launched within 45-60 business days, depending on prompt content submission and feedback. There are no setup or design fees — this service is included as part of your active subscription.
  • This promotion does not include advanced development, third-party integrations, or non-scope custom requests unless agreed upon separately in an Advanced plan.
  • Refunds will not be issued for setup, partial months, or ongoing subscriptions once the website has been published. Canceling the subscription stops future billing but does not entitle the customer to any refund.
  • Manifest FTS reserves the right to suspend or terminate service for violations of these terms, misuse of the platform, abusive behavior, or failure to pay.
